Well I got a phone call the other day with some interesting news, it seems john has finally crawled out from under his rock, it turns out he is in toowoomba working for a local building company Suncrest Homes, one local tradesman has already called him wanting to know why he was not paid etc, but I think he did not get much satisfaction with johns answers, john just hopes everyone forgets it and it all goes away, anyway why not give him a call of encouragement, I know I will,

Friday I took a call about whether I had received a letter from SVPartners asking for the money back from what I received from Coral Coast Homes etc, after being in a bit of shock momentarily, I said what! I was told that Kevin Bragg the brick layer had been sent a letter asking for the money back, how can this be? After receiving a few emails from Rob messenger’s press release, I read it quickly, I cannot believe SVPartners are trying to use this corporations Act 588FF to say that preferential payment was made, Kevin has provided goods and services, and like any other tradesman wants to be paid!, this law does not apply, how was he to know whether John Biles was solvent or not, even the BSA could not tell, the BSA even with there so called Audits said that Coral Coast Homes was Solvent, so how is a Tradie to know? This is just Rubbish! As for me this has implications as I received money in this time period also, for goods and services? Does that mean they will come after me too? I can tell you I will be fighting all the way if they try this, I talked to Kevin yesterday about the situation and told him he has my full support on this issue, and we will do what’s necessary to change this outcome!

A local building business owner affected by the collapse of Coral Coast Homes has been told by the company’s newly appointed Liquidator (see attached letter) to return money which was previously awarded by a tribunal to the former Coral Coast Homes customer.

Member for Burnett Rob Messenger was contacted by Kevin Bragg, owner/Director of Bundaberg business ‘Brickfred Pty Ltd’, who received a letter from Coral Coast Homes liquidators, demanding that he pay $12,000.

“The Liquidators are now claiming that I should have known they (Coral Coast Homes) were trading insolvent, but had I have known that, why would I be wasting money with the business?” Mr Bragg said.

“We were sick of not being paid and forced go through court process and now liquidators turn around and say you don’t deserve that money – hand it back !?

“I’ve done everything by the book… I’m very disappointed to receive the letter like that.

“I’ve gone through every legal process and followed to the letter what the solicitor was saying and what the tribunal’s findings recommended,” he said.

“Mr Bragg is obviously extremely disappointed to receive the liquidator’s letter and has approached me for help,” said Mr Messenger.

“I’ll be writing to the Attorney-General and Minister responsible for the BSA on behalf of Mr Bragg, asking that the government investigate the Liquidator’s letter of demand and advise if it is a reasonable and legal demand,” he said.

Mr Messenger is also concerned that there may be other victims of the Coral Coast Homes Crisis who have received a similar letter of demand from liquidators and is urging anyone in the same predicament as Mr Bragg to contact his office for assistance.

Its been a while since I have posted there has been not much to add, as everyone involved knows that John Biles did not show for his court appearance “surprise” and I have exercised my rights by issuing a warrant for his arrest, which has led to John and Veronica making themselves very scarce, there is a number of people who would like to know where they are at the moment?, me included, the media has also been making numerous calls to me about any info they can get and where are they? I guess time will tell, they got to eventually come out from under the rock that they are hiding under, eventually they will have to deal with there Crimes, in the meantime the authorities are arguing about who is to blame? They are all running for cover, I am personally disappointed with the way the BSA have handled things, after having a good conversation with Ian Jennings, he was telling me how they have all these resources at there disposal, to deal with things like this, I almost started to believe him? I have since realized that even if they do have all these resources at there disposal, they have a bigger problem in implementing it in the real world, when it comes to the Crunch it does not work, its unenforceable, they are Truly a Toothless Tiger! Which is known to people like John Biles, that’s why they getaway with what they do, so who is to blame for all this mismanaging, unfortunately it is we the people, we vote and pay these people to look after our interests, we the people need to yell, scream, jump up and down, do whatever it takes to get the BSA, fair trading or government departments to implement genuine enforceable laws to protect the person in the street, from the likes of the John Bile’s of the world, this is one lesson I have learnt from this experience, unless you take action nothing will change.

PS.  If anyone has a picture of John Biles can you email it to me, a number of media outlets have been requesting this and I need to make up a few Wanted Posters too…..

A few things have happened in the last week or so, on the 13th May 22, 2009 I went to Bundaberg Court House, to ask the Court to issue a Summons for John Biles to appear in Bundaberg Court on the 11th June, to answer why he has not paid the adjudication amount that was awarded to me, this non payment raises a lot of Questions as to why he has not paid it?, the only main reason seems to be that Coral Coast Homes has no money, I mean what normal person would purposely Flush his Company down the drain?, after this was sorted with Bailiffs,  I met with Ian Jennings and his team, at the court house along with a few other tradesman, at this meeting Ian handed me a Cheque for $6700.00 that he was able to secure from John Biles when they met with him earlier, to discuss why he was not paying anyone, I was grateful for this, but unfortunately this was short of what was owed to me, John had bluffed Ian to what the true amount was?, for the next hour the tradesman that came and myself  had a informative talk about the CCH situation with Ian and his team, we also made Strong Criticism of the BSA position in the regulating of Builders especially now in the wake of all  the Global problems, I feel we make a lot of valid points, as for Change I guess we will have to wait and see?, the wheels turn very slowly?. As for the current situation Coral Coast homes still owe me $1361.00 left to pay, I am glad it is down to this amount, but I am still going forward with the Court date, to recover what’s left, hopefully this can be recovered, but the amount of tradesmen that are owed money, it could be to much for him to pay, as I personally believe that the Company is Insolvent. I feel sorry for a lot of people that are owed money, but this has been going on for years, and he should have been closed down sooner, it would have stopped a lot of people being caught.

Yesterday Morning I talked to Rob Messenger about the situation and he said he is willing to help everyone, but he needs everyone to submit to him there claims against Coral Coast Homes, there details and how much is owed, so he has something to work with, he has suggested doing a media interview to cover from BSA issues to builder Issues, I have agreed to participate in this event, also the information gathered, he wants to submit to parliament on the 19^th of this month to the minister for housing about these issues also, I am currently waiting for him to set dates.

A lot of tradesmen have contacted me, because of the adjudication case I ran against john biles of Coral Coast Homes, this is available for public viewing at the BCIPA website for all to see, my case against him was 100% plus costs my way yet despite this he still would not pay by due time, which I thought was quite crazy thing to do, because the next step is for the bailiffs to seize assets, to the value enough to pay the account up, which for any so called respectable company, would be Commercial suicide, anyway despite this I have had no option but to submit judgment to Hervey Bay Magistrate Court to be enforced, the first time, yes I did say first time, I don’t know if its one of johns nine lives kick in or not but while I was there filing the paper work, a fax was coming through at my office saying they wanted to pay up the account, so after talking to the officers I temporary held off continuing, which I then made a call on the spot to Coral Coast Homes office getting John Nairn, who promised me that it was genuine no mucking around, which I thought well finally it will be over, well come the middle of next week still no money, wtf again ringing them, no one available again, I left a message that I would be going back to the court house, which seem to prompt something because on Friday, the secretary rang to let me know that she was putting money in my account, finally! Guess my shock when she told me, she was only authorized to put $2000 in the account, I promptly told her that was not good enough by any means, after that I text messaged the two Johns that come next week, I will finish filing the paperwork, which I have now done. I am currently waiting for the bailiffs to issue John with a summons to explain his contempt for the court system, and what his Company’s financial position is. Which seems to take forever? It should not be this hard?
